I think so(I'm not a lawyer), this is why. The laws are wiretapping laws, it is just so common that people TAP the conversation and stream that information to a audio recording device. If someone where to TAP a conversation and use a piece of software to transcribe the audio and delete all other records, it should still be illegal because the TAP took place. It would at least not be admissible in court as the transcript would come from the tree of forbidden fruit albeit a different branch. I don't think jails datamine cell phones. I thought they used people to monitor the hardlines. But whatever the NSA uses its 10 times better than what you can get commercially, at least I hope so. It's the NSA!
