Past tense. Dan Whatley found out about it when he was notified that he had ALREADY LOST and now owed Xybernaut nearly half a million dollars. This is not uncommon, as I noted with my own AmEx example. It was not a SLAPP, but I lost the suit without ever being notified of its existence, and didn't find out about it at all for eight months, well after I had already lost. And sure, he may have the ruling overturned on appeal, but at the expense of his time and his son's college tuition fund. The fact that Xybernaut would do this in the first place is enough for me to not deal with them.
